2. Description of Service

ClickTimer provides a countdown timer service that generates dynamic animated GIF images for use in email campaigns and websites. The Service allows you to:

  • Create customizable countdown timers
  • Generate unique URLs for countdown GIFs
  • Embed countdowns in emails and websites
  • Track impression analytics

3. Account Registration

To use certain features, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account.

4. Usage Credits and Billing

4.1 Credits

The Service operates on a credit-based system where each impression (GIF load) consumes one credit. Credits may be:

  • Included in subscription plans (monthly refresh)
  • Purchased as one-time credit packs (never expire)
  • Provided as promotional credits

4.2 Billing

For paid plans:

  • Subscriptions renew automatically unless canceled
  • Prices are subject to change with 30 days notice
  • Refunds are provided only as required by law
  • Failed payments may result in service suspension

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Send spam or unsolicited commercial emails
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or harmful code
  • Attempt to hack or disrupt the Service
  • Create countdowns for illegal, fraudulent, or deceptive purposes
  • Resell or redistribute the Service without authorization

6. Intellectual Property

6.1 Our Rights

ClickTimer and its original content, features, and functionality are owned by ClickTimer and protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of any countdown configurations you create. By using the Service, you grant us a license to:

  • Store and process your countdown data
  • Generate and serve countdown GIFs
  • Display your countdowns as examples (with permission)

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance (with notice)
  • Suspend service for technical issues
  • Modify or discontinue features

We are not liable for service interruptions or data loss. You should maintain backups of important countdown configurations.

8. Termination

8.1 By You

You may terminate your account at any time through your account settings. Upon termination:

  • Your countdowns will stop functioning immediately
  • Your data will be deleted within 30 days
  • Unused credits are forfeited (no refunds)

8.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Fail to pay for services
  • Remain inactive for an extended period

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months
  • We are not responsible for lost profits, data, or business opportunities

11. Indemnification

You agree to indemnify and hold ClickTimer harmless from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights

12. Dispute Resolution

For any disputes:

  • Contact us first to resolve informally
